We are also confident that you will appreciate this inexpensive service and consider utilizing our legal services for preparing your non-provisional patent application. While we recommend that patent applications filed with the USPTO should be prepared and filed by a qualified patent attorney, we realize that some inventors and businesses are willing to take a calculated risk to save money up-front in the patent process. The purpose of this service is to ensure that self-drafted applications are at least properly filed with the USPTO (ensuring proper disclosure is up to you). For $89 (plus the $110 USPTO filing fee), Neustel Law Offices, LTD offers this provisional patent application filing service for inventors and businesses that have chosen to prepare their own provisional patent applications. We file all of our provisional patent applications electronically with the USPTO so you are immediately notified of your filing date and serial number.

WHAT YOU GET FOR $199

You get the following from Neustel Law Offices, LTD with the provisional filing service:

  • Electronically File Provisional Application. Usually within 2 business days of receipt of your self-drafted provisional application, we will electronically file it with the USPTO (without modification by us).
  • Pay the USPTO Filing Fee. We pay the $110 USPTO filing fee.

  • Notification of Filing. We will electronically notify you that we have filed your U.S. provisional application with the USPTO.

  • Copy of Filing. We will electronically provide you with a complete copy of everything that was filed with the USPTO on your behalf (PDF format).

  • Attorney of Record. We will remain as the contact and attorney of record for your U.S. provisional patent application for any future USPTO communications.

  • USPTO Filing Receipt. We will notify you and provide you with a copy of the USPTO filing receipt that we receive which will include your official serial number and filing date.
You simply need to provide us with your provisional application that you want filed printed on 8 1/2" x 11" white paper (black and white only).  It is recommended to send your provisional application via FedEx or U.S. Certified Mail for tracking purposes. We do not accept electronic documents for the provisional filing service to ensure that the provisional application we file with the USPTO is everything that you want filed (electronic files sometimes print differently or are sometimes not printed at all for various reasons). If you have an emergency filing deadline (e.g. a one-year public disclosure date approaching shortly), talk to our staff immediately to determine the best method of providing the provisional application to us. Please keep in mind that we do not review your self-drafted provisional application to ensure that you are satisfying the legal requirements of 35 U.S.C. 112, first paragraph -- this is up to you!
